Terms of Service

1. Agreement to Terms

By accessing or using MailFluently ("Service"), operated by MailFluently ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Description of Service

MailFluently is an AI-powered business email writing assistant that helps non-native English speakers craft professional emails. The Service uses artificial intelligence to generate email drafts based on user-provided context and selected parameters such as scenario type and tone.

The Service is a writing assistance tool and is not an email sending service, email marketing platform, or bulk email tool.

3. Account Registration

  • You must create an account using Google OAuth to access the Service.
  • You must be at least 18 years old or the age of majority in your jurisdiction.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information during registration.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Payment

MailFluently offers the following subscription plans:

  • Free Plan: 1 email generation per day with basic features.
  • Starter Plan ($5/month or $49/year): 20 email generations per day with standard features.
  • Pro Plan ($12/month or $99/year): Unlimited email generations with premium features.

All payments are processed by Polar, our Merchant of Record. Polar handles all billing, payment processing, tax calculation, and VAT compliance on our behalf. By subscribing to a paid plan, you agree to Polar's terms of service in addition to these Terms.

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through the billing portal. Upon cancellation, you retain access to paid features until the end of your current billing period.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Generate spam, phishing, or fraudulent emails.
  • Create deceptive, misleading, or harmful content.
  • Harass, threaten, or impersonate others.
  • Violate any applicable laws or regulations.
  • Distribute malware or engage in any form of cyberattack.
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models.
  • Use automated scripts or bots to access the Service beyond normal usage.
  • Resell, redistribute, or sublicense access to the Service without our written consent.
  • Generate content that promotes discrimination, violence, or illegal activities.

We reserve the right to suspend or terminate your account immediately, without prior notice or refund, if we determine that you have violated this Acceptable Use Policy.

6. Intellectual Property

Our IP: The Service, including its design, features, code, AI models, and branding, is owned by MailFluently and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

Your Content: You retain ownership of the text you input into the Service. The email drafts generated by the Service based on your input are yours to use without restriction. You grant us a limited, non-exclusive license to process your input solely for the purpose of providing the Service.

7. AI-Generated Content Disclaimer

The emails generated by MailFluently are created using artificial intelligence and are provided as drafts for your review. You are solely responsible for:

  • Reviewing all generated content before sending.
  • Ensuring the accuracy and appropriateness of the content.
  • Any consequences resulting from sending emails based on generated drafts.

We do not guarantee that generated content is error-free, factually accurate, or appropriate for every situation. AI-generated content may occasionally contain inaccuracies or biases.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILPILOT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

10. Indemnification

You agree to indemnify and hold harmless MailFluently from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service will immediately cease.
  • Your data will be retained for 30 days, after which it will be permanently deleted.
  • You may request immediate data deletion by contacting us.
  • Any outstanding payment obligations will remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Seoul, Republic of Korea.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
